The designations were issued pursuant to Executive Orders 14059 (illicit drugs) and 13224 (terrorism), together with Executive Order 14367, which designated fentanyl and its precursors as Weapons of Mass Destruction. The designated Mexican companies played roles including brokerage of chemical precursors, importation and customs clearance, logistics and transportation, and served as front companies for the network. The risks arising from these designations are not limited to those sanctioned: any company with commercial or financial relationships — whether direct or indirect — with designated individuals or entities may face FIU investigations, freezing of bank accounts, OFAC fines, loss of certifications (VAT, IEPS, IMMEX and AEO status) and restrictions on exports to the U.S.

Companies are urged to promptly identify any links with designated parties, assess their level of exposure, and strengthen their due diligence and compliance programs.

The Economy, Trade, and Competitiveness Committee of the Chamber of Deputies published a preliminary draft opinion supporting the Federal Executive’s initiative to amend 1,463 tariff classifications of the LIGIE Tariff, with an expected effective date of January 1, 2026. The proposed changes cover sectors such as textiles, apparel, steel, plastics, auto parts, footwear, glass, aluminum, among others, with potential tariff increases of up to 25% or 35%.

Framed within the “Plan Mexico” economic strategy, these measures aim to strengthen domestic production and reduce reliance on imported inputs, significantly impacting costs, contracts, and supply chains, thereby making a detailed review of the affected tariff headings and available mitigation mechanisms essential.

On October 14, 2024, the Tax Administration Service (SAT) published in the Official Federal Gazette the Second Resolution of Modifications to the General Rules of Foreign Trade for 2024, which includes significant changes to Annexes 1, 2, 5, and 24.

These modifications directly impact IMMEX and certified companies, introducing new requirements for registration in the certification scheme, as well as adjustments to the guarantees of the fiscal interests of VAT and IEPS. Among the highlights are the reforms to rules 7.1.2 and 7.4.1, which establish stricter conditions for temporary imports and fiscal guarantees. In light of these developments, it is essential for companies to assess their situation and comply with the new obligations within the established deadlines.
