Special Information Briefing COVID-19 (No. 38): The new Royal Decree-law which extends measures to support economic recovery

On 23 November, the Council of Ministers approved and published Royal Decree-law 27/2021, which extends certain measures to support economic recovery, in the Official State Gazette. Among other measures, RDL 27/2021 extends the deadline for liquidity and solvency assistance, the exclusion of financial losses in 2020 and 2021 for the purposes of the dissolution of businesses due to losses, the extension of the moratorium on the obligation to file for insolvency in the case of asset imbalances, as well as the establishment of a clear framework for foreign direct investment in 2022.

On 29 September 2021, Royal Decree-law 18/2021 of 28 September on urgent measures for the protection of employment, economic recovery and improvement of the labour market was published in the Official State Gazette and entered into force.

RDL 18/2021 contains measures for the defence of employment and economic reactivation including the extension of Temporary Redundancy Plans under certain circumstances, until 28 February 2022. In addition, RDL 18/2021 expands upon and enhances measures already adopted in other Royal Decrees such as Royal Decree-law 8/2020 of 17 March, on extraordinary urgent measures to address the economic and social impact of COVID-19, Royal Decree-law 11/2020, of 31 March, adopting additional urgent social and economic measures to address COVID-19 and Royal Decree-law 30/2020, of 29 September, on social measures in defence of employment.

Special Information Briefing on COVID-19 (No. 36): Features of the sixth tranche of the guarantee facility established by RDL 8/2020 and 15/2020 to alleviate the economic effects of COVID-19

As part of the measures adopted to alleviate the economic effects of COVID-19, on 1 June 2021 the Resolution of the Council of Ministers of 28 May 2021 was published, approving the implementation and the terms and conditions of the sixth tranche of the ICO guarantee facility. This sixth tranche is for EUR 15 billion, and is intended to guarantee debt (in particular, that arising from new investments) granted to self-employed individuals, SMEs and larger companies by certain regulated financial entities. Up to EUR 10 billion will be distributed to SMEs and the self-employed, and up to EUR 5 billion will be distributed to companies that do not qualify as SMEs.

On 13 March 2021, Royal Decree-law 5/2021, of 12 March was published in the Official State Bulletin (Boletín Oficial del Estado). Royal Decree-law 5/2021 contains extraordinary measures to support business solvency in response to the COVID-19 pandemic and establishes a series of additional measures to support the solvency of viable companies that face a severe decline in revenue due to the prolonged downturn in certain sectors and regions most affected by COVID-19.
