Key aspects of the Data Act: how does this Regulation affect you?

The Data Act is a Regulation designed to regulate access to and the use of data generated by connected devices. It is directly applicable in all Member States of the European Union.

The Data Act is cross-sectoral, meaning it affects all types of entities (e.g. the banking, automotive, technology, and pharmaceutical sectors, etc.).

The Regulation is based on a new principle: the user of a device (whether an individual or a company) has the right to access the data they generate and share it with third parties.

This Regulation is intended to complement the GDPR1, which established the protection of personal data as a fundamental right, but now focuses on data as an economic asset.

Managing IP has launched a new series focusing on how IP firms and organisations such as IP offices are using AI to help manage routine tasks and improve efficiency. As part of the series, we sat down with Raúl Rubio, a partner in Spanish firm Pérez-Llorca’s IP and technology practice.

He discussed the firm’s AI journey and why simply adopting the technology isn’t enough to beat the competition, especially when most firms are using it in some form.

EU AI Act: What should the public sector do?

The deployment of AI in the public sector promises greater efficiency and reduced bureaucracy, but also raises serious concerns about its potential impact on individual rights and societal structures. Aware of such high stakes, the EU AI Act imposes stringent compliance obligations on public entities, particularly in relation to high-risk AI systems. Compliance demands a systematic inventory of AI systems, clear identification of institutional roles (provider or deployer), risk classification, and the adoption of robust organizational and technical safeguards. Timely implementation is critical to ensuring legal alignment with instruments such as the GDPR, protecting fundamental rights, and reinforcing public trust while modernizing administrative processes.

This initiative sets out a multi-year agenda that focuses on safeguarding fundamental rights, anticipating regulatory challenges, and promoting responsible technological innovation in rapidly evolving digital environments.
