Prior to joining Pérez-Llorca, Jesús worked as a lawyer at an international firm specialised in financial regulation, the Spanish Association of Insurers and Reinsurers (UNESPA), and another prestigious Spanish firm.

Experience

Jesús Almarcha has over seven years of experience providing legal advice to Spanish and international financial institutions, especially in the insurance sector.

Jesús is an expert in project and operations management, as well as in the resolution of technical queries in the field of national and international regulation in the insurance sector. In this regard, he has been involved in some of this sector’s most significant regulatory transactions, such as adapting insurance entities’ business models to the demands of solvency II, advising on the valuation of technical provisions and management of investments, improving insurance entities’ system of governance, communicating and submitting information to the DGSFP (Spanish Directorate-General for Insurance and Pension Funds), advising on the development of the free provision of services and the right of establishment in Spain and in other European countries, obtaining licences to operate in different branches of insurance, providing technical analysis of insurance contracts, advising on developing insurance distribution activity (intermediaries and insurance companies), and issuing opinions and reports on regulatory issues of particular complexity, among others. Jesus has also collaborated on the development of regulatory projects in the insurance sector through the preparation of proposals for modifications and amendments before governmental and political institutions.

Jesús is also an expert in providing transactional insurance and reinsurance advice through the creation of guarantee systems with insurance contracts in financing transactions, drafting and negotiating commercial contracts in mergers and acquisitions of insurance companies and insurance intermediaries, portfolio transfer agreements, insurance distribution contracts, establishing joint ventures and drafting and negotiating reinsurance and co-insurance agreements as risk management mechanisms.

Jesús has also advised on litigation and arbitration in a wide variety of civil, criminal and commercial matters before all courts, including appeals before the Supreme Court and appeals for constitutional protection before the Constitutional Court, relating to damage insurance (general liability, D&O, transport, surety, etc.) and personal insurance (life risk, unit-linked, accident, etc.), reinsurance and coinsurance.

Academic and publishing collaborations

Jesús has taught classes on Insurance Law at the Universidad de Castilla-La Mancha (UCLM) and the Universidad Complutense de Madrid.
