Proposed new LGEEPA: Key Changes and Implications for Businesses and Investment Projects

The Bill proposes a comprehensive update to Mexico’s federal environmental framework, introducing new assessment mechanisms, enhanced compliance obligations, and broader inspection and enforcement powers.

The Bill to enact a new General Law of Ecological Balance and Environmental Protection (LGEEPA) would comprehensively replace the current legislation and materially modify the framework applicable to projects and operations subject to federal environmental regulation. Key changes include the creation of a Strategic Environmental Assessment, expanded requirements for Environmental Impact Statements, broader investigation and monitoring powers, an expanded liability regime for companies and third parties, and a substantial increase in penalties.

The Bill remains subject to the legislative process and may therefore be amended before its approval and publication.
