Proposed Reform Seeks to Establish the Right to Digital Disconnection Across All Sectors

The proposed labor reform on digital disconnection seeks to recognize workers’ right not to respond to work-related communications outside their working hours, vacations or rest periods, and would apply to all forms of employment, not only teleworking arrangements.

In an interview with Reforma, Luis Enrique Cervantes, partner in the Labor practice at Pérez-Llorca México, explained that the initiative responds to the growing use of digital tools that have extended employees’ availability beyond working hours.

If approved, the reform would require employers to respect this right and establish internal policies and mechanisms to monitor working hours, as work-related contact outside scheduled hours could give rise to legal liabilities.
