Giancarlo Cresci focuses his professional practice on the prevention and resolution of disputes related to constitutional procedural law and, in particular, although not exclusively, constitutional proceedings involving amparo, enforcement actions (cumplimiento), and habeas data. He also has experience advising companies in the energy, telecommunications, mining, pharmaceutical, and agricultural sectors, among others.

Experience

His professional experience focuses on the prevention and resolution of disputes related to constitutional procedural law and, in particular, although not exclusively, amparo, enforcement actions (cumplimiento), and habeas data proceedings. He has also advised companies in the energy, telecommunications, mining, pharmaceutical, and agricultural sectors, among others. He served as Jurisdictional Advisor to the Constitutional Court of Peru from 2001 to 2015.

He was a member of the Constitution and Rules of Procedure Committee of the Congress of the Republic of Peru, where he was invited to participate as an expert in connection with the reform of the Constitutional Procedural Code, particularly regarding amparo and habeas data proceedings, during the 2015–2020 legislative period.

Academic and Publishing Collaborations

He has been a speaker at courses, workshops, and seminars on Constitutional Procedural Law in Peru and abroad. He is also the author of several articles on constitutional matters published in national and international publications.

In 2013, he published his first book entitled “Criteria of the Constitutional Court on the Ratification, Removal, and Appointment of Judges and Prosecutors.”

He has also received various recognitions from prominent public institutions for his extensive work as an academic and lecturer, including:

  • Letter of commendation from the Presidency of the Constitutional Court of Peru for his participation as a lecturer in the Postgraduate Program on Fundamental Rights organized by the Continuing Education Center of the Pontifical Catholic University of Peru, 2007 edition.
  • Letter of recognition from the Dean of the School of Law of the Peruvian University of Applied Sciences (UPC) for his participation as a speaker at the event on Economic Constitutional Law in the Jurisprudence of the Constitutional Court.
  • Letter of recognition from the Deputy Executive Secretary of the Inter-American Drug Abuse Control Commission (CICAD), an entity of the Organization of American States (OAS), for his collaboration in the organization of the Inter-American Meeting on Alternative Development.
  • Resolution No. 148-2013-USAT-FD issued by the School of Law of Santo Toribio de Mogrovejo Catholic University, Chiclayo, Peru, recognizing his participation as a speaker at the International Seminar entitled “Administration of Justice and Judicial Policy”, with the presentation “The Role of the Constitutional Judge: Approaches from the Jurisprudence of the Constitutional Court.”
  • Recognition from the Constitutional Court of Bolivia for his participation as a speaker at the workshop “The Enforcement Action and the Popular Action.”
