Contracts Without AI Clauses: the New Legal Challenge Facing Producers, Agencies and Brands in Mexico

Daniel Morán, Partner in the Civil and Commercial Litigation practice at Pérez-Llorca, contributed to a feature on the legal challenges facing companies, agencies and producers following the entry into force of reforms regulating the use of image, voice and performances through artificial intelligence tools in Mexico.

In his contribution, Daniel Morán highlighted the need for companies to strengthen their documentation and contract review processes in light of a regulatory environment that demands increasingly specific authorisations for the use of image, voice and performances. In particular, he noted that documentary traceability will be a key element in managing risks and evidencing the scope of the consents granted.

He also warned that organisations must review not only their agreements with talent, but also those with agencies, producers and other intermediaries, in order to ensure that the use of artificial intelligence tools and the exploitation of content comply with the new legal requirements and reduce potential litigation risks.
