Comment on the ruling issued in Amparo Directo 6/2025 by the Second Chamber of the Mexican Supreme Court regarding the registration of works generated by artificial intelligence

09/09/2025

For the first time in Mexico, the Second Chamber of the Supreme Court ruled on the impossibility of registering works generated exclusively by artificial intelligence as copyright-protected creations.

In Amparo Directo 6/2025, the Court held that only natural persons may be considered authors under the current legal framework, reaffirming the inherently human nature of copyright. The decision confirms that AI-generated works lack autonomous creativity and therefore cannot be registered or be subject to moral or economic rights. This precedent paves the way for future discussions on the need for new legal concepts capable of addressing the challenges of the digital environment, while safeguarding the central role of human creativity.
