Publication of the new General Administrative Provisions on the Social Impact Statement for the Energy Sector

On February 16, 2026, the Ministry of Energy published in the Federal Official Gazette the new General Administrative Provisions on the Social Impact Statement for the Energy Sector, replacing the former Social Impact Assessment regime and redefining the requirements applicable to energy sector projects in Mexico.

The new Provisions introduce the Social Impact Statement for the Energy Sector (MISSE) as a mandatory instrument for certain projects in the hydrocarbons, electricity, biofuels and geothermal sectors, classifying its submission into three differentiated formats based on the nature, scale and complexity of the project. They also establish specific rules regarding the delineation of the area of influence, the identification of differentiated social impacts, the mandatory incorporation of a gender perspective, prior consultation with Indigenous or Afro-Mexican Peoples and Communities, as well as criteria for defining shared social benefits and social investment. The Provisions further regulate the validity of authorizations, substantial modifications and the transitional regime applicable to pending applications.
