General and financial taxation
Our department’s advice seeks to ensure our clients make the right decisions in terms of direct and indirect taxation, at all administrative levels, in order to optimize their investment options or specific tax structures or to bring them in line with regulatory amendments and their specific needs at any time. The advice provided is of an ongoing advisory nature or caters to a specific set of circumstances, and is carried out prior to the implementation of tax changes and concludes with the relevant opinions and reports and, where appropriate, with the filing and processing of tax consultations with the General Directorate of Taxes.
The tax litigation area is a fundamental area of our tax advice.
This work includes advice and collaborations on tax audits and similar proceedings launched by the tax authorities, as well as the preparation of appeals in the administrative courts or contentious-administrative courts. Our legal defence encompasses intervention before all kinds of administrative bodies and courts, including the Supreme Court, The Constitutional Court and the Court of Justice of the European Union.
The department has significant experience in preventive advice regarding tax disputes: advice on the preparation of defence files and defence strategies in relation to the implementation of tax benefits such as incentives to R+D+i, processing of APAs, formalization of agreed assessments, etc.
Transactions and International Taxation
The team works with Pérez-Llorca’s Corporate and Real Estate practices to advise national and international clients on the taxation of corporate and real estate transactions, with the aim of achieving maximum possible efficiency of the direct taxation of the shareholders and companies involved, of the indirect taxation, and regional and local taxes. The team participates in all kinds of processes: LBOs, MBOs, MBIs, private equity transactions, insolvency and distressed transactions, financing of infrastructures, acceleration, incubation, and financing rounds mainly for start-ups, and with significant experience in setting up and advising Spanish REITs.
The international taxation practice includes the design and implementation of tax-efficient corporate structures for non-resident clients investing in Spain, or for Spanish clients who decide to internationalise their activities.
We provide our clients with multidisciplinary advice focused on their financial investment and inheritance planning needs. We keep up to date with the latest doctrinal and case law in order to react immediately to any potential risks or special circumstances.
