Does personal nature define employment relationships?

In November 2017, the United Kingdom’s Central Arbitration Committee rendered an award in which it analysed the legal relationship of Deliveroo’s distributors with the home delivery company. The award put special emphasis on the personal nature of being an employee; and considered that delivery drivers were not employees because their contracts stipulated that they could be, and were in reality, replaced by people with no relationship to Deliveroo. The interpretation of the Valencia Labour Inspection Authorities, and later ratified by the Madrid Labour Inspection Authorities, is different.
