Several European countries have recently announced their intention to withdraw from the Energy Charter Treaty. These announcements add to the ongoing discussion on the future of intra-EU investment arbitration. This webinar will address: (i) the European Union’s view through the European Court of Justice’s judgments on Achmea, Komstroy and PL Holdings, (ii) what the international arbitration community is saying about these rulings and how they affect ongoing and closed arbitral proceedings, and (iii) the possible design and structure of a future dispute settlement system for intra-EU investment arbitration.
