The Patent Law 24/2015, which was implemented on 1 April 2017, has updated the previous Law, the Law of Invention Patents and Utility Models 11/1986, in two ways: (i) for the first time, it legislates on issues that were, de facto, already raised relatively frequently in patent proceedings (the admission of preventive pleadings or patent limitation), and (ii) it introduces new elements such as the period of time given to answer the claim and the ineffectiveness of the rule included in Article 337 of the Civil Procedure Law.
