This new Legal Briefing analyses the concept of "claim" (reclamación), a key element of any civil liability insurance contract.

It is so crucial that, in order to consider an indemnifiable loss, a claim is required. Indeed, if the injured third party does not make a claim, there is no threat against the insured party’s assets and, therefore, there is no loss to speak of.

In this legal briefing we attempt to answer the question of what should be understood by “claim”, and whether it is a concept that has been defined in our legal system.
